Why must sparing someone’s feelings be ‘codified’ by legislation?

Why should an individual be forced into a disingenuous compromise of his/her principles by another?

Why should the State be allowed to mandate thought, emotion or expression?

Is not the prerogative to speak against an opposing perspective, even disparagingly, a tenet of liberty and thus protected by the first amendment?
